Terms of use for Sunny Days Ahead

The German version of these terms is the legally binding original. This English text is a translation for convenience. If the two differ, the German text prevails.

These terms govern Sunny Days Ahead, the service of SFJ Capital UG (haftungsbeschränkt) at sunnydaysahead.app. They do not govern hejsfj.com, our social media profiles, or Fred. The provider’s address and email are Dhauner Straße 42, 67067 Ludwigshafen am Rhein, Germany, hello@hejsfj.com, commercial register HRB 67315, Amtsgericht Ludwigshafen am Rhein.

1. The service

Sunny Days Ahead helps you look up which months are typically sunnier for a place. It is an informational tool. It does not book travel, accommodation, or activities, and it does not store an account as it is currently offered. If we later add accounts or payments, we will publish the additional terms on this page before they apply.

2. Figures are indicative

Sunshine information is indicative. It can be incomplete, outdated, or wrong. It is not a weather forecast for a particular day, and it is not advice about safety, health, visas, insurance, or whether you should travel. Climate and local conditions change. You are responsible for your own travel decisions and for checking official sources before you go.

3. No paid contract

Using the tool as it is currently offered does not create a duty to pay and does not form a subscription. There is no order button. Sunny Days Ahead does not store information at a user’s request for dissemination to other users, and it is not an online platform under the Digital Services Act.

4. Intellectual property

The service, its text, and its presentation belong to SFJ Capital UG or its licensors. You may use the results for your own travel planning. You may not copy the service, resell it, or scrape it in a way that degrades its availability. Place names and climate facts may also be subject to third-party rights in the underlying data.

5. Acceptable use

You may not:

  • use the service for anything unlawful
  • interfere with its security or availability
  • attempt to extract data in a way that overloads the service
  • present the figures as an official forecast or as a guarantee from us

6. Liability

We are liable under the following rules, and not beyond them:

  • We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and for a guarantee we expressly gave.
  • For a slightly negligent breach of an essential contractual duty, liability is limited to the damage that is typical and foreseeable for this kind of contract. An essential duty is one that must be performed for the contract to be carried out properly and on which you may regularly rely.
  • Any further liability for slight negligence is excluded. These limits do not remove mandatory consumer rights, including conformity and update duties for digital products under §§ 327 and following of the German Civil Code (BGB) where those provisions apply.

7. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU or the EEA, you also keep the mandatory protections of your country of residence (Art. 6 of Regulation (EC) No 593/2008, Rome I). The courts of Ludwigshafen am Rhein have jurisdiction over merchants and other users who are not consumers. If you are a consumer, you may sue in the courts of your place of residence, and we may sue you only in those courts (Arts. 17 to 19 of Regulation (EU) No 1215/2012, Brussels Ia). We do not require arbitration. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG).

8. Privacy

The Sunny Days Ahead privacy notice explains the processing. Using the tool is not consent, and these terms do not replace a consent the law requires.

9. Changes

We may update these terms by publishing a new version on this page. The new version applies to later use. Mandatory rights are unaffected. Because there is no paid term, there is no renewal to cancel.
