Terms of use for Fred
The German version of these terms is the legally binding original. This English text is a translation for convenience. If the two differ, the German text prevails. For consumers, the withdrawal instructions in the language of the contract are part of the pre-contractual information.
These terms govern Fred, the goal-setting service of SFJ Capital UG (haftungsbeschränkt) at fredgoals.com and app.fredgoals.com. They do not govern hejsfj.com, our social media profiles, or Sunny Days Ahead.
1. Provider
The contract is with SFJ Capital UG (haftungsbeschränkt), Dhauner Straße 42, 67067 Ludwigshafen am Rhein, Germany, commercial register HRB 67315, Amtsgericht Ludwigshafen am Rhein, represented by the managing director Sebastian Frederik Jacobsen, email hello@hejsfj.com. Languages for notices under Arts. 11 and 12 of Regulation (EU) 2022/2065 (the Digital Services Act), where Fred stores information at your request and is therefore a hosting service, are German and English.
2. Age
You must be at least 16 years old to create an account. A paid contract requires that you are at least 18, or that a parent or guardian with authority contracts for you. Fred is not directed at children under 16.
3. The service
Fred lets you:
- Create, edit, and track personal goals and milestones
- Add descriptions, dates, steps, and vision-board material
- Ask for an optional AI suggestion where that feature is offered
- Use a free tier, and a paid tier where we offer one
An AI suggestion is an output of an AI system under Art. 50 of Regulation (EU) 2024/1689 (the AI Act). The service identifies it as machine-generated when it is shown. It can be wrong. It is not professional advice and not a decision about you. You choose whether to save or follow it. We do not promise that a suggestion will help you reach a goal, and we do not use prohibited AI practices under Art. 5 of the AI Act.
4. Account and security
You must give accurate account information and keep your login confidential. You are responsible for activity under your login until you tell us it is being misused. Tell us at hello@hejsfj.com if you believe someone else is using your account. We may refuse a registration that is incomplete or that we reasonably believe is abusive.
5. Prices, renewal, and cancellation
The free tier does not require payment. A paid plan shows the total price, the billing period, and any tax before you order. Prices are gross prices including statutory VAT where VAT is due. If no VAT is charged because a statutory exemption applies, the checkout says so. A paid contract is formed only when you activate a button that makes the payment obligation clear, as § 312j of the German Civil Code requires, and we then make the paid features available. Payment is collected by Stripe. Stripe’s own terms govern your relationship with Stripe as a payment service; they do not replace this contract with us.
A paid plan renews for the same period unless you cancel before the renewal. We tell you the renewal terms before you order. We do not treat silence as consent to a higher price.
You may cancel a paid plan at any time, with effect at the end of the period already paid, by using the cancellation function in the interface where § 312k of the German Civil Code requires one, or by email to hello@hejsfj.com with the subject “Kündigung” and the email address of the account. Email cancellation is always accepted. Statutory withdrawal, or termination for a defect, can end the contract sooner.
6. Right of withdrawal for consumers
If you are a consumer in the EU or the EEA and you conclude a paid contract, you may withdraw from that contract within 14 days without giving a reason. The period starts on the day the contract is concluded. To withdraw, send us a clear statement (by post to the address above, or by email to hello@hejsfj.com) before the period ends. You may use the model form below, but you do not have to.
- We reimburse all payments we have received from you for that contract, without undue delay and at the latest within 14 days after we are informed of the withdrawal.
- We use the same means of payment, unless you expressly agree otherwise. The reimbursement does not cost you a fee.
- Opening the app, creating a goal, or looking at a suggestion does not by itself remove the right of withdrawal.
- The right ends early only in the cases mandatory law expressly provides, and only after any confirmation that law requires has been given. We do not shorten the 14 days in these terms.
If you asked us to begin a paid service during the withdrawal period and the law requires a proportionate payment for what was provided before you withdrew, that statutory rule applies. Otherwise we reimburse the period that was paid and not used.

7. Early end of the withdrawal right
For digital content and digital services, the law can end the withdrawal right early only if the statutory conditions are met, including an express request to start performance during the withdrawal period, an acknowledgement that the right will be lost, and a confirmation on a durable medium where §§ 356(4) and 356(5) of the German Civil Code require it. Those conditions are not met merely because you use Fred. If they are not met, the 14-day right remains.
8. Conformity of the digital service
Where §§ 327 and following of the German Civil Code apply to your contract, Fred must be in conformity with the contract, including the updates those provisions require. We do not exclude those duties. A description of a future feature is not a guarantee unless we call it a guarantee. Availability is not promised at 100 percent. Maintenance and outages can occur. If a paid feature is unavailable for a material part of a paid period because of a defect on our side, your statutory rights about price reduction, repair, or termination remain.
9. Information for distance contracts
Our identity, address, and email are in section 1 and in the imprint at hejsfj.com/imprint. The main characteristics of Fred are in section 3. The price and the billing period are shown before you place a paid order. These terms, including the withdrawal instructions, are the contract terms. After a paid order we confirm the contract on a durable medium within the time § 312f of the German Civil Code requires.
10. Intellectual property and your content
The Fred software, design, and our trademarks stay ours or our licensors’. You receive a non-exclusive right to use the service for your own goals while these terms are in force. You may not copy the software, rent it, or try to extract source code or model weights, except where mandatory law allows.
You keep all rights in the goals and other content you submit. You grant us a non-exclusive licence, limited to the time you use Fred, to host, back up, and display that content only so that we can provide and secure the service for you and comply with the law. The licence does not allow us to publish your private goals, to sell them, or to use them to train general-purpose AI models.
11. How to use AI suggestions
You must review a suggestion before you rely on it. You must not use the AI feature to generate content that is unlawful or that infringes someone else’s rights. You are responsible for what you save into your account.
12. Acceptable use
You may not:
- use Fred for anything unlawful
- upload malware or interfere with the security, integrity, or availability of the service
- access another person’s account or data
- reverse engineer the service except where mandatory law allows
- use the service to harm other people or to send them advertising without their consent
- misrepresent an AI suggestion as a statement by a named human professional
13. Notices about stored information
Fred stores goal content for the account holder. It is a hosting service under the Digital Services Act. It is not an online platform, because private goals are not disseminated to the public. If you believe stored information is illegal, email hello@hejsfj.com with your name, an explanation of why you believe it is illegal, where the information is if you know, and a statement that your notice is accurate to your knowledge. We review notices with care and without undue delay. We do not decide them by solely automated means. If we restrict an account or remove information because it is illegal or incompatible with these terms, we give the affected user a statement of reasons where Art. 17 of the Digital Services Act requires it, unless a legal exception applies.
14. Suspension and ending
You may stop using Fred at any time and you may ask us to delete the account. We may suspend or end an account that materially breaches these terms or that we must restrict by law. Where it is reasonable and lawful, we tell you first and, if we imposed the restriction, we include the statement of reasons section 13 describes. Before deletion you may ask for the export described in the Fred privacy notice, unless the law forbids the export.
15. Changes to these terms
We may change these terms for the future. If a change affects a paid subscription in a way that is not only favourable to you, we tell you at least 30 days before it applies, by email or in the service, and you may cancel before it applies. If you cancel, the previous terms apply until the paid period ends. Silence is not acceptance of a change that reduces your rights. A change required by law may apply when the law requires it, and we will tell you.
16. Liability
We are liable under the following rules, and not beyond them:
- We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and for a guarantee we expressly gave.
- For a slightly negligent breach of an essential contractual duty, liability is limited to the damage that is typical and foreseeable for this kind of contract. An essential duty is one that must be performed for the contract to be carried out properly and on which you may regularly rely.
- Any further liability for slight negligence is excluded. These limits do not remove mandatory consumer rights, including conformity and update duties for digital products under §§ 327 and following of the German Civil Code (BGB) where those provisions apply.
17. Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU or the EEA, you also keep the mandatory protections of your country of residence (Art. 6 of Regulation (EC) No 593/2008, Rome I). The courts of Ludwigshafen am Rhein have jurisdiction over merchants and other users who are not consumers. If you are a consumer, you may sue in the courts of your place of residence, and we may sue you only in those courts (Arts. 17 to 19 of Regulation (EU) No 1215/2012, Brussels Ia). We do not require arbitration. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG).
18. Privacy
The Fred privacy notice describes the processing. It is separate from these terms. Accepting these terms is not consent under the GDPR or under § 25 TDDDG. Where we need consent, we ask for it separately, and you can withdraw it.
19. Final provisions
If a clause is or becomes invalid, the rest of these terms stays in effect. The statutory rule then applies in place of the invalid clause. We do not replace it with whatever we would have preferred. EU sanctions law is reserved: we may refuse use where a sanctions rule requires it. These terms are the entire contract for Fred and replace earlier Fred terms, without reducing mandatory rights that have already arisen.
