Terms of use for the HEJSFJ social media profiles
The German version of these terms is the legally binding original. This English text is a translation for convenience. If the two differ, the German text prevails.
These terms are the house rules of SFJ Capital UG (haftungsbeschränkt) for the social media profiles we operate under the name HEJSFJ. They are not the terms of the platforms. Your use of a platform is governed by that platform’s terms.
1. Profiles these rules cover
We operate these profiles:

2. Following or messaging is not a contract
Following, liking, commenting, sharing, or sending a message does not create an account with us, a paid contract, or a duty for us to reply, follow back, or republish your content. A contract for Fred or Sunny Days Ahead is formed only under that service’s own terms.
3. House rules
You may interact with our profiles if you also follow the platform’s rules. We may hide, report, block, or ask the platform to remove an interaction that is:
- unlawful, including content that infringes copyright, personality rights, or the rights of children
- insulting, harassing, hateful, or threatening
- spam, unrelated advertising, or impersonation of us or of another person
- misleading in a way that presents unofficial content as ours
We do not watch the profiles around the clock. The platform, not us, decides what its tools allow and how it handles notices under the Digital Services Act. We are a user of the platform, not the provider of the platform.
4. Our content
Our text, video, and photographs remain protected when they appear on a platform. The platform’s share features are the ordinary way to share them. Reusing them off the platform, especially commercially, needs our prior written permission, unless a statutory exception applies. Photographs we publish on Unsplash follow the licence stated on Unsplash.
5. Names
HEJSFJ, Fred, and Sunny Days Ahead identify us and our services. Do not use them in a way that suggests you are us, that we employ you, or that we endorse a product, unless we have agreed in writing.
6. Messages are not advice or an offer
A comment or direct message is not legal, medical, financial, or travel advice, and it is not an offer or an acceptance of a contract unless we say so in a document that is clearly a contract. Do not send passwords, card numbers, or identity documents in a comment or a direct message. For privacy requests use hello@hejsfj.com.
7. Ending a profile
We may stop using a profile, or stop replying, at any time. The platform may also suspend or remove a profile under its own rules.
8. Liability
We are liable under the following rules, and not beyond them:
- We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and for a guarantee we expressly gave.
- For a slightly negligent breach of an essential contractual duty, liability is limited to the damage that is typical and foreseeable for this kind of contract. An essential duty is one that must be performed for the contract to be carried out properly and on which you may regularly rely.
- Any further liability for slight negligence is excluded. These limits do not remove mandatory consumer rights, including conformity and update duties for digital products under §§ 327 and following of the German Civil Code (BGB) where those provisions apply.
9. Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU or the EEA, you also keep the mandatory protections of your country of residence (Art. 6 of Regulation (EC) No 593/2008, Rome I). The courts of Ludwigshafen am Rhein have jurisdiction over merchants and other users who are not consumers. If you are a consumer, you may sue in the courts of your place of residence, and we may sue you only in those courts (Arts. 17 to 19 of Regulation (EU) No 1215/2012, Brussels Ia). We do not require arbitration. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG).
